Maternity & Newborn Booking Form
Thanks for booking with Emma Steiner Photography.
In order to secure your booking I require this booking form to be completed and the session fee of $249.00 to be paid as the retaining deposit.
This fee covers:
30 Minute - Maternity Session in studio or outdoor a a local location
2 Hour - Newborn Portrait Session
1 Hour - Viewing and design appointment in studio
1x 5x7" Loose Art Print
Images taken during your session are then available for purchase as prints, wall art or in digital packages or collection.
Terms & Conditions
1. ENTIRE AGREEMENT: This agreement contains the entire understanding between Emma Steiner Photography and THE CLIENT.
2. RESERVATION & CANCELLATION: Upon your signature, Emma Steiner Photography will reserve approximate dates based on your baby’s due date for your session to take place. For this reason, the retainer deposit is non-refundable. In the event that THE CLIENT cancels the contracted services for portrait photography outlined in this contract prior to the date of the photoshoot, the retainer deposit will be retained by Emma Steiner Photography.
3 AGREED DATE: Once a date for the photo session has been agreed upon by both parties, Emma will reserve this date for your session. For this reason Emma Steiner Photography requires at least 48 hours notice for any changes to this agreed date and time. Failure to provide this notice THE CLIENT forfeits their retaining deposits. Reschedules within the 48 hour notice period may transfer this deposit to another date or put towards another photography package within 6 months of the original session date subject to availability. Emma Steiner Photography makes no guarantee that the new session date requested will be available.
4. Emma Steiner Photography applies professional standards with respect to equipment, exposure, transmission, processing and printing of photographs; including using professional grade equipment and professional grade backup equipment. However, in the unlikely event of THE CLIENT’S photographs being lost, stolen or destroyed for reason within or beyond Emma Steiner Photography’s control, the latter’s liability is limited to the return of all payments received for the portrait package. The limit of liability shall not exceed the contract price stated.
5. DIGITAL NEGATIVES, PRINTS and COPYRIGHTS: The photographs, digital negatives or prints produced by Emma Steiner Photography are protected by Copyright and may not be reproduced in any manner without Emma Steiner Photography’s explicit written permission. Upon final payment by THE CLIENT, limited copyright ownership of the resulting images will be transferred to THE CLIENT with the following condition:
● The digital negatives are the property of THE CLIENT for personal use and for the purposes of the reproduction and distribution of photographs to friends and relatives.
6. MODEL RELEASE: It is agreed by the CLIENT that Emma Steiner Photography is given the irrevocable and unrestricted right to display and use the photographs taken for portfolio use, website galleries (including blogging) and promotion & advertising. Should Emma Steiner Photography wish to use the photos for any other purpose other than stated above, written permission must be obtained from the CLIENT prior to use.
7. THE CLIENT agree to positive cooperation and communication for the best possible result for the portrait session. Emma Steiner is not responsible for key individuals’ failure to be present or to cooperate during photography sessions.
8. Shooting commences at the agreed scheduled time. Should THE CLIENT arrive late due to any reason whatsoever, Emma Steiner will not be held liable for any photographs not taken. The session does not automatically extend due to late arrival.
9. VIEWING APPOINTMENT: It is agreed that the viewing appointment will be scheduled and attended within 30 days of the newborn photo session taking place. Any orders of digital files &/or prints must take place during the viewing appointment as no online galleries are available. For this reason it is recommended that both financial decision makers are present at this appointment. Additional viewing appointments are available at $100 per hour.
10. PAYMENTS: THE CLIENT agrees that the deposit is required at the time of contract acceptance.
11. ORDERS: All processed orders are final. Due to the custom nature of photography, strictly no refunds on or your order total will be issued. Un-purchased images will be available for a period of 90 day(s) after the date of the client’s session and then purged permanently. All ordered images will be archived for 12 month(s). All ordered images and products will be delivered direct to the Client unless otherwise stated.
12. RIGHT OF WITHDRAWAL: Emma Steiner's discovery of new information, changes to agreed circumstances, or other factors which tends to bypass its policies may result in its withdrawal. Non-cooperation; changes in locations, facilities or available times; missed appointments and late payments are examples of contributing factors. Should Emma Steiner initiate the withdrawal, all fees will be returned, excluding deposit as well as fair market value for all services/products already provided.
